If you’re financially stable and feel like you can handle raising your child solo, you might choose to waive child support and deviate from the child support guidelines. Remember Child Support is based of your gross monthly income and can be modified when there is an increase, or decrease of more than 20% of the child support amount owed. However, in circumstances where good cause can be shown the Court will in some cases allow child support to be deviated downward to zero. 

It’s a big decision, but sometimes it’s the most peaceful route.

Is any of this common?

Not really. Most of the time, the parent with custody needs some financial help. And that’s totally understandable! Raising a kid is expensive. But in unique cases, opting out of child support can happen.

A Few Things to Keep in Mind

  • Laws are varied: Each state is different. You need to get advice on your specific situation, not just trust some random blog.
  • Get it in writing: If you and your ex do agree on no child support, make it official through the courts. Verbal agreements are worth it if things turn sour later.
  • Think of the kids: Even if you’re struggling, is opting out really what’s best for your child in the long run? Their needs should always come first.
